Silva sentenced to probation in road-rage case

SAN DIEGO COURTS — A mother who, along with her son, was shot by an off-duty police officer during a road-rage incident in Oceanside last year was placed yesterday on five years' probation.

If Rachel Silva, 29, violates any terms of probation — including an order to remain in a residential treatment program for drug and alcohol abuse — she could be sent to prison for four years.

During the lengthy sentencing hearing, San Diego Superior Court Judge David Danielsen noted Silva's history of drinking and driving, and described her past performance on probation as "abysmal."

He said the year leading up to the March 15, 2008, shooting was particularly troublesome, given Silva's arrests for driving under the influence and child endangerment. Read the full text of the article here
