California Realtors Retain Licenses in Good Standing During Investigation, Trial and Appeal
Due process often prevents the Department of Real Estate from revoking a Realtor's license immediately upon arrest or even indictment.  Consequently, many California Realtors are able to continue working and maintain a "license in good standing" even if they are being investigated or have been charged with a crime.

As stated on firsttuesdayjournal.com, managing Deputy Commissioner at the DRE, Charles "Bill" Koenig has stated that "the DRE is always looking for new ways to ensure licensees have the appropriate qualifications and adhere to the highest ethical principals."  Some people in the real estate industry argue that licenses should be revoked sooner, but others argue that people remain innocent until found guilty.  Having a professional license revoked is a serious penalty and should be reserved for where an individual has received their day in court.

Realtors are sometimes even able to keep a license in good standing even if they have been convicted of a crime, whether they are appealing the decision or not. In a recent news story a reporter found that at least 45 of 260 individuals who had been charged with a real estate violation maintained a license in good standing.
